1) Provider identity
These Terms (the “Terms”) govern access to and use of the
Piggy Bank platform (the “App”, website, donation pages, QR codes and related services, together the “Platform”) provided by:

By creating an account, using the platform, or making a donation, you accept these Terms.
2) Definitions
User: any person using the Platform.
Beneficiary: a User creating a Piggy Page and receiving
donations.
Donor: a User making a donation.
Guardian: a parent/legal representative managing use by a minor.
Piggy Page: a personalised donation page (goal, description, messages).
Payment Provider: the regulated institution processing payments and payouts (e.g., Stripe or another PSP).
3) Purpose and Role of Piggy Bank
3.1. The Platform enables, in particular: (i) creating and managing a Piggy Page; (ii) sharing a donation link/QR code; (iii) collecting donations processed by a Payment Provider; (iv) receiving payouts to a bank account (subject to checks); (v) optionally connecting a physical Piggy Bank
device (if offered).
3.2. We are a technology provider. We are not a bank, we do not hold Users’ funds and we do not provide regulated payment services. Payments/payouts are carried out by the Payment Provider under its own terms.
3.3. Certain features may be limited, delayed or blocked for security, compliance (AML/CFT), sanctions, fraud, disputes, or Payment Provider requirements.
4) Eligibility – Minors
4.1. To create a Beneficiary account, you must be 18 and
have legal capacity, unless a Guardian creates and manages the account for a
minor.
4.2. If the Piggy Page is in the name of or for the benefit of a minor, the Guardian: (i) confirms legal authority; (ii) accepts the Terms and remains responsible for the account; (iii) is responsible for payout
requests, checks and legal obligations.
4.3. We may refuse access to certain countries/persons (sanctions, Payment Provider restrictions, or legal obligations).
5) Account – Information and Security
5.1. You must provide accurate, complete and up‑to‑date
information.
5.2. You are responsible for keeping credentials confidential. Any action performed through your account is deemed to be performed by you.
5.3. We may request documents/evidence (KYC) at any time,
especially prior to a payout.
6) Donations – Operation and Nature
6.1. The Donor makes a donation via the payment flow
displayed on the Piggy Page.
6.2. Unless explicitly stated otherwise on the Piggy Page, the Beneficiary is presumed to be the recipient of the funds.
6.3. No guarantee: a donation may fail or be cancelled (bank rejection, fraud/compliance checks, payment error, etc.).
6.4. Donor responsibility: the Donor is solely responsible for verifying the Beneficiary’s identity, the purpose of the donation, and
their right/capacity to donate.
7) Fees
7.1. Fees may apply (shown before payment or in the price list): Platform service fees, Payment Provider fees, FX fees (if applicable), device‑related fees (shipping, etc.).
7.2. Applicable fees and who bears them (Donor and/or Beneficiary) are described here: [pricing link].
8) Refunds, Cancellations, Disputes and Chargebacks
8.1. Principle: donations are generally final, except where
required by law or at our discretion (clear fraud, obvious mistake, etc.).
8.2. Disputes/chargebacks: if a Donor disputes a payment,
the Payment Provider may refund the Donor, charge dispute fees, and debit the
Beneficiary’s balance.
8.3. If a donation already paid out to the Beneficiary is
later cancelled/disputed, the Beneficiary may end up with a negative balance
and must repay the amounts due (including fees) to the extent permitted by law.
9) Payouts to the Beneficiary (KYC, timing, holds)
9.1. Payouts are made by the Payment Provider to the
Beneficiary’s bank account (or another authorised method).
9.2. Checks may cause delays or holds (KYC, AML/CFT,
sanctions, fraud, unusual activity).
9.3. Bank processing times are outside our control. Any
estimates shown are not guarantees.
9.4. The Beneficiary is responsible for tax and reporting
obligations (if applicable).
10) Prohibited uses (zero tolerance)
You must not use the Platform for illegal activities, fraud,
money laundering, sanctions circumvention, impersonation, misleading
information about the Beneficiary, unlawful content, or infringement of
third‑party rights.
We may suspend/close accounts and report to authorities
where required by law.
11) Piggy Page – content, visibility, moderation
11.1. You warrant you hold the rights to all content (text,
photo, logo).
11.2. We may remove/restrict a Piggy Page or content that
breaches these Terms, Payment Provider rules, or the law.
11.3. Depending on settings, Donor messages may be public or
private. You are responsible for your settings.
12) Physical Piggy Bank device (if sold/offered)
12.1. Ordering & delivery: terms, timelines and costs
are shown at purchase.
12.2. Compatibility: operation also depends on external
factors (Wi‑Fi, OS, network, updates).
12.3. Withdrawal (EU consumers): if you sell online to
consumers in the EU, a 14‑day withdrawal right generally applies (subject to
legal exceptions). The procedure must be specified.
12.4. Warranty: statutory warranty applies and, if
applicable, a commercial warranty [to specify], with reasonable exclusions
under applicable law.
13) Availability – maintenance
13.1. We aim for high availability, without guaranteeing
uninterrupted access.
13.2. We may perform updates, maintenance, fixes and change
features for technical, security or compliance reasons.
14) Liability
14.1. Unlimited liability only for wilful misconduct or
gross negligence, death/bodily injury, mandatory product liability, or express
written warranty.
14.2. For slight negligence, liability is limited to
foreseeable damages linked to an essential obligation, capped at: [liability

14.3. No liability for Payment Provider
decisions/interruptions, banking delays, chargebacks, payment refusals, or
losses caused by abusive use.
14.4. The User shall indemnify Piggy Bank against claims
arising from breach of these Terms, fraud, illegal content, or infringement of
third‑party rights.
15) Suspension – termination
15.1. You may close your account at any time, subject to
processing of disputes, checks and balances.
15.2. We may suspend or terminate immediately in case of
fraud, breach of these Terms, compliance requirements, or at the Payment
Provider’s request.
16) Changes to the Terms
We may amend these Terms (product evolution, security,
compliance, law). If changes are material, we will notify via the App/email
with an effective date.
17) Personal data
Data processing is described in the Privacy Policy: [link].
The Payment Provider also processes certain data under its own policies.
18) Governing law – jurisdiction
These Terms are governed by the law of [Luxembourg / other].
Courts of [Luxembourg City] have jurisdiction, subject to mandatory consumer
rules.
